Terms of Service

Last updated: 21 September 2026

1. Acceptance of Terms

By accessing or using MwalimuDocs ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

The Service is provided by MwalimuDocs, and these Terms are the agreement between you and us.

These Terms apply to everyone who accesses the Service. If you are opening an account for yourself, you must be at least 18. Learners and parents do not open their own accounts: those are created by a school on a plan that includes the Student and Parent Portal, and the school is responsible for obtaining whatever consent it needs before doing so. A learner using an account their school created is bound by the acceptable use rules in section 6, and nothing else in these Terms is asked of them.

1.1 Schools and Learners' Data

A school that keeps its learners' records on MwalimuDocs is the data controller for its learners' and their guardians' personal data. We process that data only on the school's instructions, under the Data Processing Terms its principal accepts before the school goes live.

Under those terms, the school obtains a parent or guardian's consent before it enters a learner, and a parent or guardian's explicit consent before it uses the special-needs module for that learner. The special-needs AI features are available only once the principal has accepted the current version of the Data Processing Terms.

2. Description of Service

MwalimuDocs is an educational platform that provides:

  • Schemes of work, lesson plans and lesson notes aligned with Kenya's Competency Based Education (CBE) framework and KICD guidelines
  • Records of work, formative and summative quizzes with marking schemes, and assessment rubrics
  • PDF generation and download of all of the above
  • For schools on a plan: attendance registers, student records, and optional modules for library management, timetabling, a student and parent portal, special-needs coordination and KPI reporting
  • A public page at /verify for confirming that a person presenting a MwalimuDocs Letter of Introduction is an authorised representative

Documents are produced with the help of AI models run on our behalf. Section 7 sets out what that does and does not guarantee.

We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

You are responsible for:

  • Safeguarding the password that you use to access the Service
  • Any activities or actions under your account
  • Notifying us immediately of any unauthorized use of your account

You may not use as a username the name of another person or entity that is not lawfully available for use, or a name or trademark that is subject to any rights of another person or entity without appropriate authorization.

4. Subscription and Payments

4.1 What is on offer

You can buy single documents one at a time, an Individual Term Pass covering one teacher and one grade band for a four-month term, a Department Pass covering three to five teachers in one department, or a School Enterprise plan covering every teacher at a school. Department and Enterprise plans may add optional modules. Current pricing is on our website, and prices may change with reasonable notice.

A term pass is for one named teacher. Sharing an account so that several teachers use one pass is a breach of these Terms, and the fair use limits on each pass exist to make that visible rather than to ration honest use.

4.2 Payment

Payments are taken by mobile money (M-Pesa) through licensed payment providers. Card and other rails, where they are available to you, are handled by the same providers. Every payment is authorised by you on your own device: a payment prompt arrives on the handset you name, and you approve it there.

Nobody acting for MwalimuDocs will ever ask you for cash, or for a transfer to a personal number. If anyone does, refuse and write to admin@mwalimudocs.com. We are not responsible for money handed to a person outside the payment flows described here.

4.3 Refunds

Due to the digital nature of our services, refunds are generally not provided for downloaded content. However, we may consider refunds on a case-by-case basis for technical issues that prevented service delivery. Write to support@mwalimudocs.com for refund requests.

4.4 Subscription Cancellation

You may cancel your subscription at any time from your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to the Service until then.

5. Intellectual Property

5.1 Our Content

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of MwalimuDocs and its licensors. The Service is protected by copyright, trademark, and other laws.

5.2 Your Content

You retain ownership of any content you create or upload to the Service. By creating content using our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content solely for the purpose of providing and improving the Service.

5.3 Generated Content

Content generated by our AI (lesson plans, schemes of work, etc.) is provided for your educational use. You may use, modify, and distribute generated content for legitimate educational purposes. You may not resell or commercially distribute AI-generated content without our written consent.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Submit false or misleading information
  • Upload or transmit viruses or malicious code
  • Attempt to gain unauthorized access to the Service or other systems
  • Interfere with or disrupt the Service or servers
  • Use the Service for any commercial purpose not expressly permitted
  • Resell, redistribute, or commercially exploit generated content
  • Use automated means to access the Service without our permission

6A. Field Representatives

Some schools and teachers meet MwalimuDocs through an independent field representative rather than through this website. A representative is not our employee. They are authorised only to introduce the platform, demonstrate it, and help a school onto a plan.

Every representative carries a Letter of Introduction naming them, their agent code and their authorised area, and is required to carry their National ID alongside it. You can check any of it yourself at before you act on anything they say.

A representative has no authority to vary these Terms, to promise a price that is not on our published list, to collect money in any form, or to accept documents on our behalf. Anyone applying to become a representative agrees to a separate commission agreement and code of conduct, which govern that relationship instead of this section.

7. Educational Content Disclaimer

While we strive to align all generated content with KICD guidelines and the CBE curriculum, MwalimuDocs does not guarantee that all content meets specific school, county, or national requirements. Users are responsible for reviewing and adapting generated content to meet their specific educational needs and institutional requirements.

AI-generated content should be reviewed by qualified educators before use in the classroom. We recommend verifying alignment with current curriculum standards.

8. Limitation of Liability

In no event shall MwalimuDocs, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. MwalimuDocs makes no warranties, expressed or implied, regarding the Service, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation
  • Correction of defects
  • Security or virus-free nature of the Service

10. Indemnification

You agree to defend, indemnify, and hold harmless MwalimuDocs and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of and access to the Service
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including intellectual property rights
  • Any claim that your content caused damage to a third party

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
